Family disputes that are resolved through mediation are cheaper, quicker and, according to academic research, less acrimonious than those that are settled through the courts. Despite these advantages, only some 20 per cent of people who are funded by legal aid for family breakdown cases (excluding those involving domestic violence) currently opt for mediation. Following on from a NAO report on this topic (HCP 256, session 2006-07; ISBN 9780102944525), the Committee's report examines the shortcomings of the current system for referring clients to mediation, and the actions the Legal Services Commission has in train to increase referrals to and take-up of mediation services, to improve the quality of mediation offered, and to strengthen the Commission's oversight of solicitors and mediation providers.

How is religion, particularly non-Christianness, conceptualised and represented in English law? What is the relationship between religion, race, ethnicity and culture in these conceptualisations? What might be the socio-political effects of conceptualising religion in particular ways? This book addresses these key questions in two areas of law relating to children. The first case study focuses on child welfare cases and reveals how the boundaries between race and theological notions of religion as belief and practice are blurred. Non-Christians are also often perceived as uncivilized but also, at times, racial otherness can be erased and assimilated. The second examines religion in education and the increasing focus on 'common values'. It demonstrates how non-Christian faith schools are deemed as in need of regulation, while Christian schools are the benchmark of good citizenship. In addition, values discourse and citizenship education provide a means to 'de-racialise' non-Christian children in the ongoing construction of the nation. Central to this analysis is a focus on religion as a socio-political, contingent, fluid and invented concept.

When Israel declared its independence in 1948, it vowed to ensure equality for all citizens, regardless of religion, race, or gender. History shows, however, that this promise has been broken in the case of women, who generally live under circumstances significantly worse than those of men. Women in Israel is the first comprehensive overview of discrimination in a state dominated by a patriarchal religious order, and brings fresh insights to the efficacy of the law in improving the status of women. Providing a sociolegal perspective on women in Israel viewed, Ruth Halperin-Kaddari examines all aspects of Israeli women's lives, looking at legal issues such as affirmative action, motherhood and the workplace, and mechanisms for the advancement of women, as well as conditions of education, employment, health, family, and prostitution. While tracing legislative evolution in Israel, Halperin-Kaddari discusses the extent to which law can create social change. Because of its unique position as an economically developed democracy and yet a state where government tries to maintain a special cultural tradition and religious identity in a heterogeneous society, Israel has failed to adopt a single national standard for women that would bring Israeli law into compliance with international human rights. Halperin-Kaddari concludes that the improvement in women's status has not been due to egalitarian consciousness, but rather is incidental to Israel's overall socioeconomic advancement.

Alan Watson's argument challenges the long-prevailing notion that a close connection exists between the law and the society in which it operates. His main thesis is that a society's laws do not usually develop as a logical outgrowth of its own experience. Instead, he contends, the laws of one society are primarily borrowed from other societies; therefore, most law operates in a society very different from the one for which it was originally created. The papers collected in this volume span a 35-year period of active involvement in the ‘reaffirmation and development of international humanitarian law’. A process under that name started in 1971 and ended in 1977 with the adoption of two Protocols Additional to the Geneva Conventions of 1949, one for international and one for internal armed conflicts. Subsequent developments brought a narrowing of this gap between international and internal armed conflicts, as well as growing recognition of the interplay between the law of armed conflict and human rights, the rediscovery of individual criminal liability for violations of international humanitarian law, the introduction of further prohibitions or restrictions on the use of specified weapons, and so on. In contrast with these positive developments, the period was negatively characterised by increasing disrespect, not only for some or other minor rule (such as what to do with cash taken from a prisoner of war at the time of his capture) but for the very principles underlying the entire body of the law of armed conflict: respect for the other as a human being and, hence, humane treatment of prisoners of war and other detainees, protection of civilians ... Throughout the period, the author’s activities ranged from participation in lawmaking and law interpreting exercises, through attempts at explaining the law of armed conflict in its historical context and making propaganda for its faithful implementation, to critical or even bewildered observance of actual events. The papers brought together here reflect these diverse angles.
